HS2

HS2, is the high speed railway being developed in phases from London through to Birmingham (Phase 1), Crewe (Phase 2a), Manchester and the East Midlands (Phase 2b), with potential to be extended to Leeds (which remains safeguarded).  

 

One of the key outcomes will be the increase in capacity on the classic rail network, particularly the West Coast Mainline.  This should be of real benefit to rail freight as well as regional and local passenger services.

 

Baker Rose does not act for HS2.  We have been acting for a wide range of affected parties, from Euston, through to Leeds.  We have developed a sound working relationship with HS2 with the Land and Property Team as well  its Construction Team, which enables us to treat sensibly, discuss matters pragmatically and seek proper mitigations and compensation, as appropriate.

Below are examples of some of the types of cases we have dealt with.

EUSTON

Senator Group

We were brought in to advise this significant UK based international furniture manufacturing group after a General Vesting Notice had been served. The family business owners owned the property freehold and the operational business leased the building.

 

The business had sought an early relocation but HS2 / DfT were not able to supper this.  They had three months to move and achieved it!

We have settled the freehold claim and are working to settle the relocation costs, which have been complicated by the need to move twice and mitigate costs of a larger property.

PARK ROYAL

Patisserie Patchi

We acted for a group of five business adjoining one another in Park Royal, four relocated and one could not and has been extinguished.  We were involved in early lobbying for business support and secured on option for upto £250k of advance relocation funding. 

 

Patisserie Patchi was one of the businesses which relocate.  It had to take a creative leap of faith to acquire a very different alternative premises, which included acquiring the incumbent business. 

The fit out was substantially undertaken in a record time over Christmas in 2017, with the final bakery created later.  The claim reflected the original property's value and the contribution to fit out on an equivalent basis.

The business invested heavily too and has created a very successful venue in its new location on Abbey Road.

NORTH ACTON

Development Site

This significant development site adjoins North Acton station.  We act for the pension trustee owners.  We are in negotiation with HS2 on the value, based on Appropriate Alternative Development (AAD).
